Arasu Cable’s Carriage Fee Auction stayed by the High Court

The Madras High Court on 13 July 2012 granted interim stay until further orders of the confirmation of auction by the Tamil Nadu Arasu Cable TV (TAC TV) Corporation Limited, scheduled for July 17, for fixation of carriage fee and allotment slots for satellite free-to-air and pay channels in the corporation’s cable television service in Tamil Nadu (except Chennai).
The court passed the interim order on petitions by various television channels. When the matter came up, the corporation’s counsel took notice.

In a petition, the Makkal Tholai Thodarpu Kuzhumam Ltd., which runs ‘Makkal TV’, represented by its director V. Dhanasekaran, submitted that by virtue of the tender of June 28, the State-owned corporation had brought about a monopoly in offering channels to viewers of television channels through the cable system.
The tender was for charging carriage fee from TV channels for different frequency bands in the analog cable TV networks. Except in Chennai where CAS has been fully implemented and networks are all digital, all other areas in Tamilnadu have analog cable in which only 106 channels can be accommodated.
Since there are more than 800 channels registered ARASU wants to allot these frequencies through on auction.
Originally, the entire cable network was operated by private persons. The corporation had now taken over the entire operations of cable network in all the districts, except Chennai.
TV channels allege that prior to the issue of the tender, there was no consultation with any of the television channel operators in respect of the tender and the conditions had been unilaterally fixed.
Justice K. Chandru said there would be an interim stay of the confirmation of the auction scheduled to be held on July 17 or any subsequent date until further orders.
