TDSAT stays sectoral regulator TRAI's new regulation about reducing port charges

The telecom tribunal Telecom Disputes Settlement and Appellate Tribunal (TDSAT) has stayed the implementation reduction of port charges as per TRAI’s new regulation. The TDSAT order has come after a the state-run BSNL filed a petition against the order.
The TDSAT bench was headed Chairman Justice S B Sinha, where the TRAI was directed not to implement the new regulation till October 8. October 8 is the next date of hearing the petition.
"Keeping in view the fact that by reason of the impugned regulation, the appellant (BSNL) would have to change the entire system as regards levy of the ports charges keeping in view the requirement of seekers of the port, we are of the opinion the impugned regulation may not be given effect to till the next date is fixed," said TDSAT in its interim order.
Moreover, the TDSAT has also issued notices to TRAI. The TRAI has been asked to file a reply within three days. On September 18, 2012, the TRAI had ordered reduction in port charges and had fixed Rs 10,000 a year port charges for fixed line telephone calls and at Rs 4000 for mobile services. The port is used by two telecom operators to interconnect with each other so subscribers of one network can talk to the subscribers of another network. Maximum impact of reduction in port charges would have been on BSNL.
