Spanish broadcasters fail to avoid DTT closure

The Supreme Court has rejected the Spanish broadcasters appeal against the closure of nine DTT channels urging them to close them down “without delay” in compliance with the December 18th ruling.
The affected broadcasters – namely Atresmedia, Mediaset, Veo TV and Net TV – made an appeal against the Court’s earlier decision in an attempt to avoid the closure. The Supreme Court has dismissed it on the grounds that the reasons given by the broadcasters were already rejected at previous stages in the proccedings.

The Supreme Court has also rejected the suspension of the closure while the Constitutional Court, which the broadcasters appealed to as well, makes its decision.
The nine affected channels – Nitro, Xplora and La Sexta 3 from Atresmedia; Nueve and La Siete from Mediaset; Net TV, Veo TV, AXN and Marca TV – will then have to cease transmissions before May 6th. The possibility of a new public tender to award new DTT licences is still uncertain as the Administration has said that the decision will depend on the spectrum that remains after the allocation of the digital dividend to 4G operators to be completed by January 1st 2015
