Madras HC issued notice to Arasu Cable

The Madras High Court issued a notice to Arasu Cable TV Corporation Limited (TNACTC) and Telecom Regulatory Authority of India (TRAI) on 02 March on the plea of Paattali Makkal Katchi-based Makkal TV to restore telecasting the channel 'MAKKAL TV' through Arasu cable network in S-4 frequency under the same category of Free-to-Air Channel throughout Tamil Nadu.
The court posted the matter for further hearing on April 7.
In the petition, Makkal Tholai Thodarpu Kuzhumam, represented by its Director, V.Dhanasekaran, submitted that Tamil Nadu Arasu Cable TV Corporation (TNACTC) was downlinking its signal and broadcasting it through the corporation’s cable network through Multi-System Operators as a free-to-air channel since 2011.
From March 31, 2015 TNACTC had stopped telecasting the channel without disclosing any reason. This came to the channel’s notice only on April 1.
The corporation is telecasting 38 FTA Tamil channels from 2011.
Challenging the stoppage, the channel in its petition submitted that TNACTC's act was "motivated, unilateral, illegal and arbitrary in nature."
It alleged that TNACTC action violated Articles 19(1)(a) and 19(1)(g) of the Constitution of India guaranteeing Freedom of Expression and Right to carry on business.
