Hearing the Petition No.315 (C) of 2015, the Telecom Disputes Settlement & Appellate Tribunal (TDSAT) on 8th July, has directed multi-system operator (MSO) Hathway Cable & Datacom, the respondent, not to disconnect the supply of signals to the 16 cable operators affiliated to New Delhi-based Siddhi Vinayak Cable Operators Association (SVCOA), the petitioner, until mediation process is over.
It also directed the cable operators affiliated to SVCOA to continue to make payment of the monthly subscription fees on the basis of the last payment made by them.
It has also directed both sides to appear before the Mediation Centre on 9 July. The tribunal has directed Mediation Centre to resolve the disputes between the parties expeditiously and without any unnecessary loss of time.
The association has raised a number of grievances against the MSO to which the individual cable operators are affiliated.
Advocate JK Mehta, who represented the respondent, Hathway Cable said that the MSO was equally aggrieved by non-payment of regular monthly subscription fees by the members of the petitioner association.
He also stated that the cable operators are liable to make payment of Rs 115 per STB (exclusive of taxes) prior to packaging.
At this stage, even without asking the MSO to file its reply to the petition, the tribunal felt it appropriate that the two sides should try to resolve their disputes through mediation.
